Case 4 General Average/Salvage and Carrying Equipment
The container ship of a Member was struck ob the port side by a bulk carrier while anchoring. The Member had 314 containers on board, of which 32 were constructive total losses. General average and salvage were declared. A recovery against the other ship, which was able to apply a tonnage limitation, amounted to approximately 40% of the Member's losses. A separate recovery action was pursued against the owner of the bulk carrier for salvage contributions.
